1. Information We Collect

1.1 Local Data

Your notes, tasks, attachments, and other content are stored locally on your device and remain entirely under your control. This data is not transmitted to our servers.

1.2 Cloud Sync Data

If you enable cloud sync, your data is stored on your chosen third-party service (iCloud, Google Drive, etc.). We act solely as a facilitator. Your cloud provider's terms and privacy policies govern synced data—we do not access, store, or manage it.

1.3 Diagnostic and Usage Data

We may collect limited technical information including:

• App version and device type
• Operating system version
• Crash logs and error reports
• Anonymized performance metrics (app launch times, feature usage frequency)

We never collect or analyze the content of your notes or tasks.

1.4 Optional Data

Features like reminders, notifications, or location tags use data only for their specific function and remain on your device unless synced through your cloud account.

2. How We Use Information

We use collected data solely to:

• Operate, maintain, and improve the App
• Fix crashes, bugs, or compatibility issues
• Communicate essential updates

We do not sell, rent, trade, or monetize your information, nor scan your content for analytics, advertising, or profiling.

3. Third-Party Services

When you use cloud services, their privacy policies govern your synced data. Diagnostic data may be processed using industry-standard tools that comply with Indian data protection standards. We recommend reviewing your cloud provider's policies.

4. Data Security

We implement reasonable security measures including encryption during transmission and secure storage of diagnostic information. However, no system is completely secure. The App is provided "as-is," and you accept the inherent risks of digital data storage.

5. Data Retention and Deletion

Retention:

• Your notes and tasks remain on your device until you delete them
• Cloud-synced data follows your provider's retention policy
• Diagnostic data is anonymized and retained for 90-180 days

Deletion:

You can delete data by:

• Removing items within the App
• Deleting synced data from your cloud service
• Disabling diagnostic collection in Settings > Privacy
• Uninstalling ZYSH

We do not maintain backups of your content and cannot restore deleted data.

6. Children's Privacy

ZYSH is not intended for anyone under 18 years (or the age of majority in your jurisdiction). We do not knowingly collect data from minors. If you believe a minor has used ZYSH, contact us at feedback@collatzinc.com. We will delete such data within 7 business days.

7. Data Storage and Transfers

All data processing is governed by Indian law. Minimal technical data may be processed on servers within India or by third-party providers complying with Indian data protection standards and the Digital Personal Data Protection Act, 2023.

8. Your Rights Under Indian Law

Under the DPDP Act 2023, you have rights to:

• Access information about your personal data
• Correct inaccurate or incomplete data
• Request deletion of your data
• Lodge complaints regarding data processing
• Nominate another individual to exercise your rights

9. No Monetary Claims - Free Service Disclaimer

ZYSH is provided entirely free of charge. By using ZYSH, you acknowledge and agree that:

9.1 Service Basis

• The App is provided "AS-IS" and "AS-AVAILABLE" without warranties
• You use the App entirely at your own risk
• We make no guarantees regarding availability, reliability, or data integrity

9.2 Waiver of Claims

To the fullest extent permitted under Indian law, you waive all rights to:

• Seek monetary compensation or damages of any kind
• Claim refunds (no payment made)
• Pursue claims for data loss, lost profits, business loss, or indirect/consequential losses

9.3 No Liability

We are not liable for:

• Loss, corruption, or inaccessibility of your data (local or cloud)
• Service interruption, suspension, or termination
• Issues arising from third-party services
• Circumstances beyond our reasonable control

Exceptions: Limitations do not apply to liability for willful misconduct, gross negligence, or death/personal injury caused by our negligence, as prohibited by Indian law.

9.4 Your Responsibility

You are solely responsible for:

• Maintaining backups of important data
• Securing your device and accounts
• Choosing appropriate cloud storage providers
• Understanding the limitations of free software

10. Indemnification

You agree to indemnify and hold harmless Collatz Inc., its directors, officers, and employees from all claims, liabilities, damages, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of this policy or applicable laws
• Content you store or transmit
• Claims that your use caused damage to third parties

11. Policy Updates

We may update this policy to reflect changes in technology or legal requirements. The latest version is available in the App (Settings > Privacy Policy) and at Privacy Policy page.

Continued use after updates constitutes acceptance of the revised policy.

12. Governing Law and Jurisdiction

Applicable Law: This policy is governed by the laws of India, including:

• Digital Personal Data Protection Act, 2023
• Information Technology Act, 2000
• Indian Contract Act, 1872

Exclusive Jurisdiction: All disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.

Dispute Resolution: Before litigation, you agree to:

• Contact our Grievance Officer in writing
• Allow 30 days for resolution
• Attempt good faith negotiations

Severability: If any provision is invalid under Indian law, it will be modified to minimum necessary extent or severed, with remaining provisions continuing in effect.

Entire Agreement: This policy (with any Terms of Service) constitutes the entire agreement regarding your use of ZYSH.

Language: English version prevails in case of translation conflicts.

16. Acknowledgment

Terms of Use

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use ZYSH.

2. Permitted Use

ZYSH is for personal, lawful use only. You may create notes, manage tasks, and sync data through cloud services.

Prohibited Actions:

• Storing illegal, harmful, or abusive content
• Hacking, reverse-engineering, or disrupting the app
• Unauthorized commercial use
• Violating applicable laws

3. Your Data

Local Storage: Data is stored on your device under your control.

Cloud Sync: If enabled, data is uploaded to your chosen cloud service (iCloud, Google Drive, etc.) per their terms. Collatz Inc. does not access or control synced data.

Your Responsibility: You must back up your data and secure your accounts.

Privacy: We don't collect, sell, or share your personal information. See our Privacy Policy.

Deletion: Remove local data by uninstalling the app. Manage synced data through your cloud provider.

4. Intellectual Property

ZYSH's name, logo, design, and code belong to Collatz Inc. and are protected by intellectual property laws. You retain ownership of your content.

5. Updates

We may update ZYSH and these Terms. Significant changes will be notified in-app. Continued use means acceptance.

6. Third-Party Services

Third-party cloud services operate under their own terms. Collatz Inc. is not responsible for their data handling or availability.

ZYSH is provided "AS IS" without warranties of any kind, including:

• Merchantability or fitness for purpose
• Uninterrupted or error-free operation
• Data accuracy or reliability

No Professional Advice: ZYSH is a productivity tool, not professional advice.

8. No Liability & No Monetary Claims

ZYSH is free. To the maximum extent permitted by Indian law:

Collatz Inc. is not liable for:

• Data loss, corruption, or inaccessibility
• Device damage or compatibility issues
• Service interruptions or termination
• Third-party service issues
• Any direct, indirect, or consequential damages

You waive all rights to:

• Seek monetary compensation or damages
• File claims for refunds or financial remediation

Exceptions: Death/personal injury from gross negligence, fraud, or willful misconduct.

Your Risk: You use ZYSH at your own risk and must maintain backups.

9. Indemnification

You indemnify Collatz Inc. from claims, damages, and expenses (including legal fees) arising from your use, violations of these Terms, or content you store.

10. Termination

You: Stop using ZYSH anytime by deleting it.

We: May terminate access for Terms violations without notice or liability.

Governing Law: Laws of India (IT Act 2000, Indian Contract Act 1872, DPDP Act 2023, Consumer Protection Act 2019).

Jurisdiction: Exclusive jurisdiction of courts in Bangalore, Karnataka, India.

Dispute Resolution: Contact feedback@collatzinc.com first. Allow 30 days for resolution before legal action.

12. General Terms

Entire Agreement: These Terms and our Privacy Policy constitute the full agreement.

Severability: Invalid provisions are modified or removed; remaining terms continue.

No Waiver: Non-enforcement doesn't waive rights.

Assignment: You cannot transfer these Terms. We may assign to successors.

Language: English version prevails.

Force Majeure: No liability for circumstances beyond our control.
